New York Building Permits — Complete Guide (2026)

The definitive resource for building permits across New York State and NYC

New York has two distinct permitting worlds: NYC (the most complex permit system in the US, run by DOB) and the rest of NYS (governed by the NYS Uniform Code, administered by municipalities). Heavy snow loads, coastal flood zones, and historic districts are major code drivers statewide.

⚠️ NYC is a completely separate system. The NYC Department of Buildings (DOB) operates independently from the rest of New York State. NYC requires licensed professionals (PE, RA, master electrician, master plumber) for most permit filings. Outside NYC, NYS municipalities issue their own permits under the NYS Uniform Code. Your process depends entirely on which system you're in.

How building permits work in New York

Outside NYC, building permits in New York are issued by towns, cities, and villages — not counties. Most counties have no building department. Each municipality administers the NYS Uniform Code independently. Frost depth (36–48 inches), heavy snow loads, and coastal flood zones are key compliance factors.

How to get a building permit in New York

1

NYC or outside NYC?

This is the first and most important question. NYC (Manhattan, Brooklyn, Queens, Bronx, Staten Island) uses the NYC Building Code and DOB NOW portal. The rest of New York uses the NYS Uniform Code administered by local municipalities. The processes are completely different.

2

Find your municipality (outside NYC)

In New York State, permits are issued by cities, towns, and villages — not counties. Most counties have no building department. Locate your town or village and contact their building department directly. Many now have online portals.

3

NYC: hire a licensed professional

NYC requires licensed architects (RA) or professional engineers (PE) to file most permit applications. Electrical work must be filed by a licensed master electrician; plumbing by a master plumber. Owner-builders cannot self-file most NYC permits.

4

Check snow load and frost depth requirements

New York has some of the most demanding structural requirements in the US. Ground snow loads range from 30 psf (NYC area) to 70+ psf (Tug Hill Plateau, Adirondacks). Frost depth is 36–48 inches statewide. All foundation footings must be below frost depth.

5

Flood zone and coastal check

Post-Sandy FEMA maps significantly expanded flood zones in Long Island, NYC coastal areas, and Hudson River communities. Verify your flood zone before designing. Coastal Erosion Hazard Areas (CEHA) have additional NYS DEC setbacks beyond FEMA requirements.

6

Submit plans and schedule inspections

NYC uses DOB NOW for digital submissions. Outside NYC, processes vary widely by municipality. Upstate NY municipalities are generally more affordable and faster than downstate. Foundation, framing, rough-in, and final inspections are required statewide.

Frequently asked questions — New York permits

DOB NOW is NYC's digital permit portal. Most permit filings, plan submissions, inspection scheduling, and permit status checks are handled through DOB NOW (dobnow.nyc.gov). Licensed design professionals (architects, engineers) and master tradespeople file on behalf of building owners. Homeowners can view permit status but generally cannot file applications themselves.
Outside NYC: yes, owner-builders can pull permits for their primary residence in most NYS municipalities. You'll need to complete forms certifying you're the owner-occupant and understand the code. Licensed tradespeople (electricians, plumbers) may still be required for trade work. In NYC: mostly no — licensed professionals must file most applications.
Ground snow loads vary dramatically: NYC and Long Island (20–30 psf), Westchester/Hudson Valley (30–40 psf), Capital Region/Buffalo (40–50 psf), Adirondacks/Tug Hill Plateau (70–100 psf). All structures must be engineered for local ground snow loads. Roof snow loads (after drift and slope factors) determine actual structural requirements.
New York enacted significant ADU legislation in 2024 (part of the housing compact). The law limits municipalities' ability to ban ADUs outright, allows ADUs in most residential zones by right, and restricts certain local restrictions like minimum lot size and owner-occupancy requirements. Implementation is ongoing — check your municipality's current local laws.
NYC has over 37,000 individual landmarks and 150+ historic districts governed by LPC. Any exterior change to a designated landmark building or in a historic district requires LPC approval before DOB will accept a permit application. LPC approval typically adds 2–6 months to the permit timeline. The review is aesthetic — materials, colors, and design must be appropriate to the historic character.
NYC is among the most expensive permit environments in the US — fees are high, required professionals are expensive, and processing times are long. Outside NYC, fees vary significantly: downstate suburbs (Westchester, Nassau, Suffolk) are moderate to high; upstate (Syracuse, Rochester, Albany, Buffalo) is among the most affordable in the northeastern US.
