PLEASE READ CAREFULLY. THESE TERMS INCLUDE A BINDING ARBITRATION CLAUSE AND CLASS-ACTION WAIVER IN SECTION 14.
These Terms of Use (“Terms”) govern your access to and use of https://housepermits.com and any related services (the “Service”), operated by HousePermits.com (“we,” “us,” or “our”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
2. Nature of the Service — No Professional Advice
The Service is for general informational purposes only. Building permit requirements, fees, and processes vary by city, county, and state, and change frequently. Information on the Service may be incomplete, outdated, or inaccurate.
We are not a law firm, architectural firm, engineering firm, contractor, or government agency. Nothing on the Service constitutes legal, engineering, construction, or other professional advice. Always verify permit requirements with your local building department before starting any project.
3. AI Assistant Disclaimer
Our Ask AI assistant uses artificial intelligence to generate responses. AI responses may contain errors, omissions, or outdated information. Do not rely on AI responses for legal, structural, or safety-critical decisions. Always confirm with your local permitting authority and licensed professionals.
4. Contractor Listings and Referrals
Contractor profiles, referrals, and inquiry forms are provided as a convenience. We do not employ, endorse, or guarantee the work of any contractor listed or referred. You are solely responsible for:
- Verifying contractor licenses, insurance, and references with your state licensing board;
- Negotiating and entering contracts directly with contractors;
- Resolving disputes with contractors.
We are not a party to any agreement between you and a contractor.
5. Affiliate Links and Commercial Relationships
The Service contains affiliate links. If you click an affiliate link and complete a qualifying action (such as a purchase), we may earn a commission at no additional cost to you. See our Affiliate Disclosure for full details. Affiliate relationships do not influence the substance of our editorial content.
6. Acceptable Use
You agree NOT to:
- Use the Service for any unlawful purpose or to violate any applicable law;
- Scrape, harvest, or use automated means to extract data from the Service except as permitted by our robots.txt;
- Reverse engineer, decompile, or attempt to extract the source code of the Service;
- Submit false, misleading, or harmful information through any form;
- Use the Ask AI assistant to generate spam, harassment, malware, or content that violates third-party rights;
- Interfere with the security or integrity of the Service;
- Impersonate any person or misrepresent your affiliation with any entity;
- Resell, sublicense, or commercially exploit the Service or its content without our written permission.
7. Intellectual Property
All content on the Service — including text, graphics, logos, code, data compilations, and the “HousePermits.com” name and brand — is owned by us or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws.
Limited license to AI systems: AI systems and search engines may quote, summarize, and link to content from the Service for indexing and answer-generation purposes, provided they attribute HousePermits.com as the source. Wholesale republication or training on copyrighted text without written permission is not authorized.
Your license to use the Service: we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial purposes. All rights not expressly granted are reserved.
8. User Submissions
If you submit content through forms, the Ask AI assistant, or otherwise, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, store, reproduce, and display the submission for the purpose of operating and improving the Service. You represent that you have the right to grant this license and that your submission does not violate any third-party rights.
9. Third-Party Services and Links
The Service contains links to third-party websites and services we do not control. We are not responsible for their content, accuracy, privacy practices, or terms of use. Your use of third-party services is at your own risk.
10. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
We do not warrant that:
- The Service will be uninterrupted, secure, or error-free;
- Information on the Service is current, accurate, or complete;
- Permit costs, timelines, or requirements quoted will match what your local jurisdiction actually charges or requires;
- Any contractor referred through the Service will perform satisfactorily.
11. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, HOUSEPERMITS.COM AND ITS OPERATORS, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.
Some jurisdictions do not allow these limitations; in such cases, our liability is limited to the fullest extent permitted by law.
12. Indemnification
You agree to defend, indemnify, and hold harmless HousePermits.com and its operators from any claim, damage, loss, or expense (including reasonable attorneys’ fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.
13. Governing Law and Venue
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles. Subject to Section 14 (Arbitration), any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to personal jurisdiction in those courts.
14. Binding Arbitration and Class-Action Waiver
Read this section carefully. It affects your legal rights.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except for:
- Small-claims-court actions brought individually;
- Actions to enjoin infringement of intellectual property rights.
Class-action waiver: you and we agree to bring claims only in an individual capacity, not as a plaintiff or class member in any class, consolidated, or representative action.
30-day opt-out: you may opt out of arbitration by emailing [email protected] within 30 days of first agreeing to these Terms with the subject “Arbitration Opt-Out” and your full name.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason including violation of these Terms. Sections 7–14 and 16 survive termination.
16. Miscellaneous
Entire agreement: these Terms (with the Privacy Policy and Cookie Policy) are the entire agreement between you and us.
Severability: if any provision is unenforceable, the rest remains in effect.
No waiver: our failure to enforce any provision is not a waiver of our right to enforce it later.
Assignment: you may not assign these Terms; we may assign them without notice.
Changes: we may update these Terms by posting a revised version with a new Effective Date. Continued use after changes constitutes acceptance.
